The Holiday Tram website is published and maintained by ShaVik Hospitality Services, Delhi, a company incorporated and existing in accordance with the laws of India. When you access, browse or use this website; you accept without limitation or qualification, the Terms and Conditions set forth below. When you access any subsite (whether belonging to an ‘associate’ of ShaVik Hospitality Services or otherwise) through this website, then such subsite may have its own Terms and Conditions of use which is specific to such subsite. ShaVik Hospitality Services reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of ShaVik Hospitality Services' systems, as well as its client’s interests, are and remain well-protected.
Towards this end, ShaVik Hospitality Services may take various steps to verify and confirm the authenticity, enforceability and validity of booking placed by you. If ShaVik Hospitality Services, in its sole and exclusive discretion, concludes that the said the booking is not or do not reasonably appear to be, authentic, enforceable or valid, then ShaVik Hospitality Services may cancel the said booking at any time up to 5 hours before the scheduled time of departure of the relevant flight or 5 days before the expected date of visit to any property booked through ShaVik Hospitality Services.


Usage of Collected Information

Processing Payments - When you purchase online, the required information is sent to the relevant financial institution.

Legal Requirements - ShaVik Hospitality Services reserves the right to disclose your personal information as necessary to: (a) comply with the law or comply with legal process served on ShaVik Hospitality Services; (b) protect and defend the rights or property of ShaVik Hospitality Services; (c) protect the personal safety of other ShaVik Hospitality Services websites’ users or the public; or (d) to ensure compliance with our Terms & Conditions. ShaVik Hospitality Services cooperates with law enforcement and other third parties to enforce laws, intellectual property, and other rights, and we reserve the right to report any information related to suspicion of illegal activity to law enforcement for prosecution.


Business Transfer

The user information database of this website may be shared in case of mergers, acquisition, sale, insolvency, bankruptcy or as a part of business asset transfer by ShaVik Hospitality Services.


Mode of Payment

The payment of the entire tour package has to be made before the scheduled delivery date either in form of RTGS, IMPS, NEFT, Bank Transfer and UPI. Our company discourages payment to be made by cash deposit which is above ₹1,99,000/- (Rupees One Lakh Ninety Nine Thousand only) whether in instalment or otherwise as it is in violation of the norms of the country and shall attract a penalty.


ShaVik Hospitality Services Policy

India is our company’s country of domicile.
All the refund of any transaction amount against any purchase through this website would be refunded to the original mode of payment.
Delivery information such as Customer’s Name, Location, Address and Contact Number will be stored for delivery purposes. Other personal identifiable information will not be stored.


Cancellation Policy

ShaVik Hospitality Services reserves its right to cancel the booking being made by you or even amend the same, if necessary without assigning any reasons thereof. Such amendment or cancellation may be due to circumstances beyond the control of the company. As per the policy of ShaVik Hospitality Services, the company in its best endeavours shall book alternate Hotels for you, after confirming the dates with you. However, at no point of time shall ShaVik Hospitality Services be responsible or liable to pay any compensation or damage or any other expense or business loss suffered by you due to the cancellation or amendment of the tour package booked by you.

On your booking request, ShaVik Hospitality Services holds space for you in its groups which are scheduled to travel on a specific date and space is also reserved for you in Airlines, Hotels and Coaches needless to mention that these spaces are being held subject to the bank guarantees (or any form of deposit) issued by ShaVik Hospitality Services in favour of the Third-Party service provider. If there is any change in your plan and you request for cancellation, due to any reason whatsoever the same shall be subject to the cancellation policy.


Cancellation of Booking By You

In case if you wish to cancel the tour package booked, you must notify us in writing through email. Only after the receipt of the same by our company staff, it shall be deemed that the said communication has been received by ShaVik Hospitality Services. The cancellation charges shall apply, irrespective of the reason for cancellation whatsoever, including medical emergency or pregnancy. You understand and acknowledge that these charges are genuine and are the pre-estimate of the damages that ShaVik Hospitality Services will suffer on account of cancellation being made by you.

Further in group bookings, if the cancellations are being made due to any reasons, it shall increase the cost of the entire group which cost cannot be burdened upon other group members travelling, so the cancellation charges are on the higher side in order to mitigate that loss which ShaVik Hospitality Services has to bear on account of you not travelling. However, ShaVik Hospitality Services in its best endeavour tries to mitigate the loss as minimum as possible on you in terms of the cancellation policy. You further unequivocally understand that the said cancellation charges shall be paid by you without any dispute and the same are explained to you at the time of finalisation of the itinerary. If the tour is 100% confirmed and delivered, there shall be 100% cancellation charges.


Cancellation Due to Refusal of Visa by the Embassy

Granting and rejection of VISAS is the sole discretion of the embassy. ShaVik Hospitality Services only acts as a facilitator for obtaining the VISA. The company shall, under no circumstances, be held liable or responsible for rejection of VISAS and any other related incidental or consequential loss, damage, cost or expense. If the rejection of VISA is intimated by the embassy within the cancellation period specified above, then the cancellation charges as appearing shall be applicable. For the purpose of ascertaining applicable cancellation rates, the cancellation under this head will be deemed to have been made only when we receive the intimation of VISA rejection from the embassy. Subsequently, if you choose to re-apply for the VISA, then, in that case, the cancellation charges if any shall be borne by you from the date of the second refusal if any. If in case we have received no intimation from the embassy of accepting of VISA application before the departure date of the tour, then, in that case, the maximum cancellation charges shall apply.


Cancellation Rights Due to Failed Balance Deposit

ShaVik Hospitality Services reserves the rights to cancel the tour package booked by you in case you fail to deposit the remaining balance even after several requests. In such a case we reserve the rights to cancel the tour package and shall recover the balance amount, if any, from you after adjusting the advance received.


Processing Charges

We hold our right to charge a processing fee which shall be 5% of the package cost if the booking is withdrawn by you even 5 minutes after confirmation of booking reference number being communicated to you from our end. Once confirmation is conveyed, normal cancellation charges shall be applied.


General Provisions

You may travel to certain destinations which involve greater risks than others, entirely at your risk as to the cost and consequences.
ShaVik Hospitality Services requests you to consult your local authorities and evaluate travel prohibitions, warnings, announcements, and advisories issued by them before booking travel to certain international destinations.
By offering for sale travel to particular international destinations, ShaVik Hospitality Services does not represent or warrant that travel to such point is advisable or without risk. ShaVik Hospitality Services does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.
ShaVik Hospitality Services, ShaVik Hospitality Services affiliates and their respective suppliers are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any air carriers, hotels or other suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. ShaVik Hospitality Services, ShaVik Hospitality Services affiliates and their respective suppliers have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
ShaVik Hospitality Services reserves its exclusive right in its sole discretion to alter, limit or discontinue the website or any material posted herein, in any respect. ShaVik Hospitality Services shall have no obligation to take the needs of any User into consideration in connection therewith.
ShaVik Hospitality Services reserves its right to deny on its sole discretion any user access to this website or any portion hereof without notice.
You agree to abide by the Terms and Conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in ShaVik Hospitality Services debiting your account for any costs we incur as a result of such violation.
No waiver by ShaVik Hospitality Services of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
If any dispute arises between you and ShaVik Hospitality Services during your use of the website or thereafter, in connection with and arising from your use or attempt to use this website, the dispute shall be referred to arbitration. The place of arbitration shall be New Delhi, India.
This agreement and any matter relating thereto shall be governed, construed and interpreted in accordance with the Laws of India.
You agree that in the event of any dispute on the difference between the parties, the exclusive jurisdiction of the courts/tribunals shall be of New Delhi only.


Loss of Baggage During Air Travel and Surface Travel Coach/Van

ShaVik Hospitality Services shall, in no circumstances whatsoever, be liable to you or any other person travelling with you, for loss of baggage by the airline or during coach transfers within city or otherwise. We shall not be liable for the loss or any inconvenience suffered by you in this regard. However, you shall be free to pursue your remedies independently against the concerned service provider and to lodge a claim with the insurance company for loss and damages.


Carefully Check the Itinerary

All services to be provided to you shall be as per those specified/confirmed and paid by you as detailed in the itinerary and travel voucher being handed over to you. Example if you avail any service such as porterage, room service, laundry, charge, à-la- carte meals, alcoholic beverages, soft drinks, paid toilets etc or anything that is not specifically shown as included in the Tour Cost, then the payment for the same will have to be made by you.


Company Reserves the Right to Change the Itinerary Without Any Prior Notice to You

We reserve the right to alter, amend, change or modify the tour package and itineraries before or during the tour. We will make all reasonable efforts to notify you promptly of such changes/ events sufficiently in advance during booking or prior to departure of the tour, and we will solicit your full co-operation in accepting such circumstantial changes. Therefore, no grievance with respect to change in itinerary/ service change which we are constrained to make will be entertained from you during or after the tour. Such changes may be necessitated due to factors beyond our control such as force majeure events, strikes, fairs, festival(s), sport event(s), weather condition(s), traffic problem(s), overbooking of Hotel(s), flight(s), cancellation, re-routing of flight(s) or railway, closure of/ restricted entry at a place of sightseeing etc.

Further, we go strictly by the terms and conditions, and in case our staff has assured you of anything which is contrary to the terms mentioned herein, we shall request you to obtain the same in writing in order to avoid any confusion at a later stage.
